Shapiro Arato Article on Trade Secrets Featured in State Bar Publication

Shapiro Arato partner Cynthia Arato and Erin Millender authored an article on trade secret law in the most recent issue of Inside, the quarterly Corporate Counsel Section newsletter of The New York State Bar Association. The article, “The Secret’s In the Sauce: The Defend Trade Secrets Act and the Ideal Recipe for Trade Secrets Litigation”, discusses the vigorous debate leading to the recent enactment of the Defend Trade Secrets Act of 2016 (“DTSA”) and analyzes its potential impact under New York law. The DTSA establishes the nation’s first private, civil cause of action for misappropriation of trade secrets at the federal level. Since 1979, the Uniform Trade Secrets Act (“UTSA”) has provided similar relief at the state level. New York is one of the few states that has not enacted the UTSA, relying instead on state common law.
