Our attorneys are seasoned commercial litigators with extensive experience in federal and state courts and in commercial arbitrations and mediations. We have represented national and multi-national public companies, private corporations, investment banks, partnerships, and individuals in disputes that span a wide range of industries. Our attorneys have achieved success in eliminating claims at the earliest possible stage of commercial cases, including the dismissal of claims in federal securities fraud actions. We have substantial experience in international litigations, and are well versed in the discovery issues that are unique to that context, including the Hague Convention and the European Union’s blocking statutes. We also have extensive trial experience.

Our attorneys have litigated a wide range of commercial disputes. Our commercial litigation practice includes securities fraud, breach of contract, business torts (such as breach of fiduciary duty and tortious interference with contract), fraudulent inducement, corporate governance, mergers and acquisitions and bankruptcy litigation.

Our recent notable commercial representations include:

  • Representing private equity firm in a fraud action against officers of a now-insolvent NASDAQ-listed public company in which the firm invested.
  • Representing numerous defendants in “clawback” actions initiated by the trustee in the Bernard Madoff bankruptcy proceeding.
  • Represented a private corporation and its officers and directors in a federal securities fraud action. Plaintiffs voluntarily withdrew all claims following a motion to dismiss filed by the defendants.
  • Represented officers and directors of an NYSE-traded public company in a federal securities fraud action. Plaintiffs withdrew all claims following service of a motion for sanctions by the officers and directors.
